Seller's Property Condition Disclosure Requirements
For-Sale-By-Owners (FSBOs) should be aware of South Dakota's property condition disclosure requirements. South Dakota Codified Law Chapter (SDCL) 43-4 governs property disclosure requirements. There are some exceptions under SDCL 43-4-43; however, most owners/sellers of residential homes are required to provide prospective buyers with a Seller's Property Condition Disclosure Statement (available in Adobe .pdf format*) regardless of whether the property is for sale by owner or through a licensed real estate agent.
