Options for Terminated Employees or Those Who Lose Other Coverage
An employee who is terminated can choose to have coverage continued under the group plan for 18 months or 36 months in special circumstances.
That right can be exercised within 30 days of the written notice of termination of coverage by the employer. If the individual stays covered through the entire continuation period, the person has the right to go to the South Dakota Risk Pool without health underwriting.
The right to the South Dakota Risk Pool also applies to anyone who involuntarily loses any of the creditable coverages if they have at least 12 months of creditable coverage without a significant break in coverage.
